Terms of Service

These Terms of Service ("Terms") govern your use of comethru (the "Service"), operated by The Garber Company ("we," "us," or "our") at comethru.events. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

comethru is an event marketing platform operated by The Garber Company. We provide registration, communication, and marketing services to event organizers ("Event Organizers"), and we communicate with individuals who register for or attend their events ("Attendees" or "you").

When you register for an event through comethru, you are registering both with the Event Organizer hosting the event and with The Garber Company as the operator of the platform.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service and to provide the information requested.

For SMS communications, you must be 18 or older, or have parental/guardian consent if between 13 and 17, and you must be the account holder or have permission from the account holder of the mobile number you provide.

3. User Accounts

The Service does not require you to create an account. You provide information at the point of event registration and that information is used to facilitate your participation in that event and related communications.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Provide false, inaccurate, or misleading information
  • Register on behalf of another person without their consent
  • Attempt to interfere with, compromise, or disrupt the Service
  • Use automated systems (bots, scrapers, etc.) to access the Service
  • Reverse engineer, decompile, or attempt to derive source code from the Service
  • Use the Service to harass, abuse, or harm another person

5. SMS Program Terms

By providing your mobile phone number and checking the SMS opt-in box at registration, you consent to receive text messages from comethru related to events you have registered for or attended, and promotional messages about future events from the same Event Organizer.

Program description
comethru sends event-related SMS messages including registration confirmations, event reminders, day-of logistics, post-event follow-ups, and promotional notifications about upcoming events from Event Organizers.
Message frequency
Message frequency varies based on event activity. Typically 2–8 messages per event.
Cost
Message and data rates may apply. comethru does not charge for SMS messages; your mobile carrier's standard rates apply.
Opt-out
You can opt out at any time by replying STOP to any message. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT. After opting out, you will receive a confirmation message and no further marketing messages, except as necessary to confirm the opt-out itself.

Supported carriers
We support most major US carriers including AT&T, Verizon, T-Mobile, US Cellular, Sprint, Boost, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.
Eligibility
You must be 18 years or older, or have parental/guardian consent, and you must be the account holder or have permission from the account holder of the mobile number provided.
Consent is not a condition of purchase
Your consent to receive SMS messages is not required to register for an event or to use any aspect of the Service. You can register for events without opting in to SMS.
Data handling
Mobile phone numbers, opt-in records, and SMS interaction data are handled as described in our Privacy Policy. We do not share this information with third parties for their marketing purposes.

6. Payment

The Service itself does not collect payment from Attendees. If an event requires payment, that payment is processed by the Event Organizer or their selected payment processor, subject to the Event Organizer's separate terms. The Garber Company is not responsible for payment processing, refunds, ticket fulfillment, or financial transactions related to events.

7. Relationship with Event Organizers

When you register for an event through comethru, you are entering into a relationship with both comethru and the Event Organizer. The Event Organizer is responsible for:

  • The content, conduct, and execution of the event
  • Refunds, ticket fulfillment, and event-specific customer service
  • Any payment processing related to the event
  • Compliance with venue rules, health and safety requirements, and applicable laws

comethru is not a party to your agreement with the Event Organizer regarding the event itself. We provide registration and communication infrastructure only.

8. Intellectual Property

The Service, including its design, code, content, logos, and trademarks, is owned by The Garber Company or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our written permission.

User-submitted content (responses to event questions, etc.) remains your property, but you grant The Garber Company and the relevant Event Organizer a non-exclusive, worldwide, royalty-free license to use that content for the purpose of operating the event and the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not warrant the accuracy, completeness, or reliability of any event information provided by Event Organizers. We are not responsible for cancellation, rescheduling, or changes to events.

We do not guarantee delivery of any SMS or email message. Delivery depends on carrier networks, recipient device status, and other factors outside our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GARBER COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless The Garber Company, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 8, 9, 10, 11, and 14) will survive.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last Updated" date. Material changes will be communicated via email to Event Organizers and, where appropriate, to Attendees. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction and venue of those courts.

You agree that any claim must be brought in your individual capacity and not as part of a class action.

15. Miscellaneous

Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and The Garber Company regarding the Service.
Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
No waiver
Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment
You may not assign these Terms. We may assign them without restriction.
